Starting with July 1st, 2022, declaring the transport of goods with high fiscal risk will be mandatory.

What is the RO e-transport system?

On April 8, 2022, the Government approved the law 41/2022 for the implementation of the integrated electronic system RO e-Transport which will monitor the transport of goods. The system will monitor in real time the movement of goods with high fiscal risk on the Romanian territory, as follows:

  • transport of goods purchased and delivered in the EU
  • transport of goods subject to customs operations
  • transport of goods between two locations located in the national territory

RO e-Transport includes IT modules for the management of goods transportation, which will generate unique registration codes for each transport, interconnection elements with cameras and other specific devices for monitoring road traffic and software components for integrated data analysis.

The RO e-transport system, which will become mandatory from July 1, 2022, will make it mandatory to declare in advance the transport data, depending on the type of operation, the beneficiary or, as the case may be, the Romanian supplier. The data will be valid for a predetermined period from the date of commencement of the transport, and the system will allow the modification of the declared data until the entry into the national territory or until the start of the transport. As an exception, in the case of goods with a high tax risk temporarily unloaded on the territory of Romania, the obligation to declare falls on the depositary.

The categories of transport vehicles and the categories of goods with high fiscal risk transported by road that will be monitored and the application procedure of the RO e-Transport System are established by Order of the President of the National Agency for Fiscal Administration, respectively by joint order of the Presidents of the National Agency Fiscal Administration and the Romanian Customs Authority.

ANAF proposed the following list of goods with high fiscal risk transported by road that are monitored through the RO e-Transport System:

  1. Vegetables, plants, roots and tubers, foodstuffs, falling within CN codes 0701 to 0714 inclusive.
  2. Edible fruits; peel of citrus fruits or melons falling within CN codes 0801 to 0814 inclusive.
  3. Beverages, alcoholic beverages and vinegar falling within CN codes 2201 to 2208 inclusive.
  4. Salt; sulfur; earths and stones; plaster, lime and cement falling within CN codes 2505 and 2517.
  5. Articles of apparel and clothing accessories, knitted or crocheted, falling within CN codes 6101 to 6117 inclusive.
  6. Clothing and clothing accessories, other than knitted or crocheted, falling within CN codes 6201 to 6212 inclusive and CN codes 6214 to 6217 inclusive.
  7. Footwear, gaiters and the like; parts of these articles falling within CN codes 6401 to 6405 inclusive.
  8. Iron, cast iron and steel that fall within CN codes 7213 and 7214

Who has the obligation to declare?

According to the provisions of the Ordinance, the following categories of persons will have the obligation to declare in the RO e-Transport System the goods with fiscal risk:

  • the consignee mentioned in the import customs declaration;
  • the consignor mentioned in the export customs declaration;
  • the beneficiary of the goods, the supplier in the case of local and EU supplies of goods;
  • the depositary, in the case of goods which are the subject of EU transactions in transit, both for goods unloaded on the territory of Romania for storage or for the formation of a new transport, and for goods loaded after storage or after the formation of a new transport on national territory.
     

What is UIT?

UIT code - is the unique code generated by the RO e-Transport System through which the goods in the transport with high fiscal risk are identified.

The system will record the data on the consignor and the beneficiary, the name, characteristics, quantities and value of the goods transported, places of loading and unloading, details on the means of transport used.

The person who has the obligation to declare will make this UIT code available to the carrier, which will be obligatorily entered on the transport document.

On which transport document does the UIT code appear?

The UIT code will have to be listed on the transport documents, whether we are talking about a CMR document, a consignment note or other delivery document (POD).

Economic agents could consider issuing an electronic MRL, taking into account the fact that Romania has acceded to the Additional Protocol on the Electronic Accompanying Letter (eCMR) to the Convention on the Contract for the International Carriage of Goods by Road by Road (MRL). , by Law 29/2019.

Economic operators should take into account that the optional use of the RO e-Transport System at this time will become mandatory from 1st of July 2022.

Failure to comply with the provisions of the e-Transport Ordinance will be sanctioned, starting with July 1st 2022, with fines between 5,000 lei and 100,000 lei, as well as confiscation of the undeclared goods.
